You are right and is stupid the government just does not manufacturer some evidence and try him on that evidence. I mean everyday there are unclaimed body found in big cities, just take one about the right age and sex and then hire some forensic scientist with some packets of untraceable cash and they will testify it is Tracy then hey shoot it with a couple of bullets from one of his guns that police have and poof he is guilty and we can kill him.
